Their principal standard is to &ldquo;provide effective, equitable, understandable and respectful quality care and services that are responsive to diverse cultural health beliefs and practices, preferred langauges, health literacy, and other communicationeeds.&rdquo;<\/p><p>Here are some policies within the federal&nbsp; legislation related to communication and healthcare:&nbsp;<\/p><ul><li>Offer language assistance to individuals who have limited English proficiency and\/or other communication needs, at no cost to them, to facilitate <br>timely access to all health care and services.<\/li><li>&nbsp;Inform all individuals of the availability of language assistance services clearly and in their preferred language, verbally and in writin<\/li><li>&nbsp;Ensure the competence of individuals providing language assistance, recognizing that the use of untrained individuals and\/or minors as interpreters <br>should be avoided.<br>8. It also applies to the United States Congress.<\/p><p>Here are some critical portions of the ADA related to communication and cultural competence:<\/p><ul><li><p>Title IV addresses telephone and television access for people with hearing and speech disabilities. It requires common carriers (telephone companies) to establish interstate and intrastate telecommunications relay services (TRS) 24 hours a day, 7 days a week. TRS enables callers with hearing and speech disabilities who use TTYs (also known as TDDs), and callers who use voice telephones to communicate with each other through a third party communications assistant. Title IV also requires closed captioning of Federally funded public service announcements.<\/p><\/li><li><p>The Fair Housing Act, as amended in 1988, prohibits housing discrimination on the basis of race, color, religion, <span class=\"glossaryLink\"  title=\"Glossary: sex\"  aria-describedby=\"tt\"  data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;sex&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;Sex refers to the biological differences between individuals that are male-aligned or female-aligned, such as the genitalia and genetic differences. Sex is not the same as gender. I use these terms &amp;lt;strong&amp;gt;&amp;quot;male-aligned&amp;quot;&amp;lt;\/strong&amp;gt; or &amp;lt;strong&amp;gt;&amp;quot;female-aligned&amp;quot;&amp;lt;\/strong&amp;gt; because it is more representative of identities. A reader provided a great example, that not everyone who is female aligned has matching parts. Trans women can be female aligned whether or not they&rsquo;ve had surgery, and folks who have female parts may be male-aligned or non-binary.&lt;\/div&gt;\"  data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]'  tabindex='0' role='link'>sex<\/span>, disability, familial status, and national origin. Its coverage includes private housing, housing that receives Federal financial assistance, and State and local government housing.&nbsp;<\/p><\/li><li><p>The Civil Rights of Institutionalized Persons Act (CRIPA) authorizes the U.S. Attorney General to investigate conditions of confinement at State and local government institutions such as prisons, jails, pretrial detention centers, juvenile correctional facilities, publicly operated nursing homes, and institutions for people with psychiatric or developmental disabilities. Its purpose is to allow the Attorney General to uncover and correct widespread deficiencies that seriously jeopardize the health and safety of residents of institutions. CMS<span lang=\"EN\" xml:lang=\"EN\">&nbsp;doesn&rsquo;t exclude, deny benefits to, or otherwise discriminate against any person on the basis of race, color, national origin, disability, <span class=\"glossaryLink\"  title=\"Glossary: sex\"  aria-describedby=\"tt\"  data-cmtooltip=\"&lt;div class=glossaryItemTitle&gt;sex&lt;\/div&gt;&lt;div class=glossaryItemBody&gt;Sex refers to the biological differences between individuals that are male-aligned or female-aligned, such as the genitalia and genetic differences. Sex is not the same as gender. I use these terms &amp;lt;strong&amp;gt;&amp;quot;male-aligned&amp;quot;&amp;lt;\/strong&amp;gt; or &amp;lt;strong&amp;gt;&amp;quot;female-aligned&amp;quot;&amp;lt;\/strong&amp;gt; because it is more representative of identities. A reader provided a great example, that not everyone who is female aligned has matching parts. Trans women can be female aligned whether or not they&rsquo;ve had surgery, and folks who have female parts may be male-aligned or non-binary.&lt;\/div&gt;\"  data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]'  tabindex='0' role='link'>sex<\/span>, or age in admission to, participation in, or receipt of the services and benefits under any of its programs and activities, whether carried out by CMS directly or through a contractor or any other entity with which CMS arranges to carry out its programs and activities.<\/span><\/p><\/li><li><p><span lang=\"EN\" xml:lang=\"EN\">CMS provides free auxiliary aids and services&nbsp;including information in accessible formats like Braille, large print, data\/audio files, relay services and TTY communications.&nbsp;<\/span><span lang=\"EN\" xml:lang=\"EN\">If you request information in an accessible format from CMS, you won&rsquo;t be disadvantaged by any additional time necessary to provide it.&nbsp;&nbsp;<\/span><span lang=\"EN\" xml:lang=\"EN\">This means you will get extra time to take any action if there&rsquo;s a delay in fulfilling your request.<\/span><\/p><\/li><li>Get health care services in a language you understand and in a culturally-sensitive way.<\/li><li>Your rights as a nursing home resident include the right to b<span style=\"font-size: 16px;\">e free from discrimination.<\/span><\/li><\/ul><p>Source: <a href=\"http:\/\/medicare.gov\">medicare.gov<\/a><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-1169853 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"1169853\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-f731c0d\" data-id=\"f731c0d\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-215fd9f elementor-widget elementor-widget-heading\" data-id=\"215fd9f\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Medicaid<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-dd8838a elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"dd8838a\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-8128c8f\" data-id=\"8128c8f\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-a6477df elementor-widget elementor-widget-text-editor\" data-id=\"a6477df\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Medicaid is a joint federal and state program that, together with the Children&rsquo;s Health Insurance Program (CHIP), provides health coverage to over&nbsp;<a href=\"https:\/\/www.medicaid.gov\/medicaid\/index.html\">72.5 million<\/a>&nbsp;Americans, including children, pregnant women, parents, seniors, and individuals with disabilities. Medicaid is the single largest source of health coverage in the United States. &nbsp;&nbsp;&nbsp;<\/p><p>Programs and Expansions within Medicaid Related to Cultural Competence:<\/p><ul><li><p>The Affordable Care Act of 2010 created the opportunity for states to expand Medicaid to cover nearly all low-income Americans under age 65. Eligibility for children was extended to at least 133% of the federal poverty level (FPL) in every state (most states cover children to higher income levels), and states were given the option to extend eligibility to adults with income at or below 133% of the FPL. Most states have chosen to expand coverage to adults, and those that have not yet expanded may choose to do so at any time. See if your state has expanded Medicaid coverage to low-income adults.<\/p><\/li><li>Medically Needy Program: &nbsp;for individuals with significant health needs whose income is too high to otherwise qualify for Medicaid under other eligibility groups. Medically needy individuals can still become eligible by &ldquo;spending down&rdquo; the amount of income that is above a state&rsquo;s medically needy income standard. Individuals spend down by incurring expenses for medical and remedial care for which they do not have health insurance. Once an individual&rsquo;s incurred expenses exceed the difference between the individual&rsquo;s income and the state&rsquo;s medically needy income level (the &ldquo;spenddown&rdquo; amount), the person can be eligible for Medicaid. The Medicaid program then pays the cost of services that exceeds the expenses the individual had to incur to become eligible.<p>In addition to states with medically needy programs, 209(b) states also must allow a spenddown to the income eligibility levels eligibility groups based on blindness, disability, or age (65 and older), even if the state also has a medically needy program.
